As per the Ministry of Finance notification S.O. 4718(E) dated 04.10.2022, DRT Jaipur exercises jurisdiction over the entire State of Rajasthan — making it the sole DRT bench for one of the largest states in India. Every borrower and lender in Rajasthan, regardless of which district their property or bank branch is located in, must file before DRT Jaipur. Under the RDB Act, a case can only be filed where the amount in dispute is Rs. 20 lakh or more. Under the SARFAESI Act, the threshold is much lower — a borrower can file a Section 17 Securitisation Application where the secured debt is Rs. 1 lakh or more. Applications involving debt of Rs. 100 crore and above are transferred to DRT-III Delhi.
Appeals against DRT Jaipur orders go to DRAT Delhi. A borrower filing an appeal must pre-deposit 50% of the determined amount, though this can be reduced to as low as 25% in appropriate cases.
For writ petitions challenging SARFAESI or DRT action, the correct forum is the Rajasthan High Court. The Rajasthan High Court has its principal seat at Jodhpur and a bench at Jaipur. Which bench has jurisdiction depends on where the secured property is located — matters involving properties in districts falling under the Jaipur Bench jurisdiction go to Jaipur, while those in districts under the Jodhpur jurisdiction go to Jodhpur. Getting the correct bench right at the outset avoids avoidable delay.
